Please read these terms carefully before enrolling. They govern your use of our services, admissions process, and student obligations.

Agreement to Terms

Welcome to the Shri Mahakal Institute ("Institute", "we", "us", "our"). These Terms of Use ("Terms") constitute a legally binding agreement between you (the "Student", "User", "you", "your") and the Institute governing your enrollment in our programs, use of our educational services, access to our facilities and platforms, and participation in Institute activities.

By submitting an application, accepting an offer of admission, enrolling in any program, accessing our learning management systems, attending classes (online or in-person), using Institute facilities, or otherwise engaging with our services, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy and any program-specific guidelines.

If you do not agree to these Terms, you must not enroll in our programs or use our services. Your continued enrollment or use of our services constitutes ongoing acceptance of these Terms and any future modifications.

Scope of Agreement: These Terms apply to all individuals who interact with the Institute, including prospective students, enrolled students, executive education participants, alumni accessing continuing services, audit students, and visitors to our campus or digital platforms.

Eligibility & Admission Requirements

Enrollment at the Shri Mahakal Institute is subject to meeting our admission requirements and maintaining eligibility throughout your program. By applying or enrolling, you represent and warrant that:

Misrepresentation: Providing false, misleading, or incomplete information during the application or enrollment process constitutes a material breach of these Terms and may result in immediate dismissal without refund, even after graduation. Degrees conferred based on fraudulent information may be revoked.

Use of Educational Services

The Institute grants you a limited, non-exclusive, non-transferable license to access and use our educational services, facilities, and platforms solely for legitimate educational purposes during your enrollment period. This includes:

Learning Platforms: Access to our learning management systems, online course materials, video lectures, discussion forums, digital libraries, and collaborative tools for the duration of your enrollment and as specified in your program terms.

Campus Facilities: Use of physical campus facilities including classrooms, libraries, study spaces, computer labs, and common areas during designated hours and in accordance with posted rules and regulations.

Support Services: Access to academic advising, career counseling, technical support, library resources, writing centers, and other student support services as available to enrolled students in your program.

Collaborative Learning: Participation in group projects, study groups, networking events, guest lectures, and co-curricular activities that enhance your educational experience.

Academic Records: Ability to view your grades, request transcripts, monitor degree progress, and access your official academic records through the student portal.

Alumni Services: Upon successful completion of your program, access to alumni networks, career services, continuing education opportunities, and lifelong learning resources as defined in our alumni benefits program.
Service Modifications: The Institute reserves the right to modify, suspend, or discontinue any service, course offering, facility access, or platform feature at any time with reasonable notice. We may substitute instructors, change course schedules, alter curricula, or adjust program delivery methods to maintain academic quality or respond to unforeseen circumstances.

Tuition, Fees & Payment Obligations

Enrollment constitutes your agreement to pay all applicable tuition, fees, and charges associated with your program. Payment obligations and policies include:

Price Changes: The Institute reserves the right to adjust tuition and fees for future academic periods with reasonable advance notice. Current students are generally protected from mid-program tuition increases unless extending beyond the standard program timeline.

Intellectual Property Rights

Intellectual property rights regarding educational materials, student work, and Institute assets are governed as follows:

Copyright Infringement: Unauthorized reproduction, distribution, public performance, or sharing of copyrighted Institute materials constitutes copyright infringement and violates these Terms. Violations may result in disciplinary action, legal action, and liability for damages.

Prohibited Conduct & User Responsibilities

To maintain a safe, productive, and respectful learning environment, you agree not to engage in the following prohibited activities:

System Misuse

Do not attempt to gain unauthorized access to Institute systems, networks, or accounts. Do not introduce malware, viruses, or malicious code. Do not circumvent security measures or authentication protocols.

Account Sharing

Your student account credentials are personal and confidential. Do not share login information, allow others to access your account, or impersonate other students, faculty, or staff members.

Harassment & Discrimination

Do not engage in harassment, bullying, discrimination, hate speech, threats, or intimidation based on protected characteristics or otherwise. Respect diversity and maintain professional standards in all interactions.

Disruptive Behavior

Do not disrupt classes, examinations, events, or campus operations. Do not engage in activities that interfere with the learning, research, or working environment of others.

Illegal Activities

Do not use Institute resources for illegal purposes, including but not limited to copyright infringement, illegal file sharing, fraud, identity theft, or any violation of local, national, or international law.

Unauthorized Recording

Do not record classes, lectures, private conversations, or campus activities without explicit consent from all participants and instructors, except as permitted under accessibility accommodations.

Commercial Use

Do not use Institute resources, facilities, platforms, or relationships for unauthorized commercial purposes, multilevel marketing, or solicitation of students, faculty, or staff.

Misrepresentation

Do not misrepresent your affiliation with the Institute, make unauthorized statements on behalf of the Institute, or falsely claim credentials, achievements, or endorsements.

Disclaimers & Limitations of Liability

Your use of Institute services and facilities is subject to the following disclaimers and limitations:

No Employment Guarantees: While the Institute provides career services and placement assistance, we make no guarantees regarding employment, salary levels, job placement, career advancement, or specific employment outcomes. Career success depends on multiple factors beyond our control.

Educational Content: The Institute strives to provide accurate and current educational content, but makes no warranties regarding the completeness, accuracy, or applicability of course materials. Students are responsible for independent verification and professional judgment.

Third-Party Content: Our programs may include guest lectures, case studies, and materials from third parties. The Institute does not endorse and is not responsible for the accuracy, views, or content provided by external speakers or third-party materials.

System Availability: While we strive for continuous access, we do not guarantee uninterrupted availability of our online platforms, learning management systems, or digital resources. Technical issues, maintenance, and unforeseen outages may occur.

Personal Property: The Institute is not responsible for loss, theft, or damage to personal property on campus or during Institute-sponsored events. Students are responsible for securing their belongings and obtaining appropriate insurance.

Limitation of Liability: To the maximum extent permitted by law, the Institute's total liability for any claims arising from your enrollment or use of services is limited to the tuition fees paid for the current academic period. We are not liable for indirect, consequential, special, or punitive damages.

External Links: Our platforms may contain links to external websites and resources. We are not responsible for the content, privacy practices, or availability of third-party sites and do not endorse their content.

Health & Safety: Students participate in Institute activities at their own risk. While we maintain safety standards, we are not liable for injuries, accidents, or health issues except where caused by our gross negligence or willful misconduct.
Force Majeure: The Institute is not liable for failure to perform obligations due to events beyond our reasonable control, including natural disasters, pandemics, government actions, labor disputes, technical failures, or other force majeure events. We may modify program delivery or suspend services as necessary during such events.

Termination & Withdrawal

Your enrollment and access to Institute services may be terminated under various circumstances. Both you and the Institute have certain rights and obligations regarding termination:

Voluntary Withdrawal

You may withdraw from your program at any time by submitting formal written notice through the student portal or registrar's office. Refunds are subject to published refund schedules based on withdrawal date. Outstanding financial obligations remain due.

Academic Dismissal

The Institute may dismiss students who fail to maintain minimum academic standards, fail required courses, or do not make satisfactory progress toward degree completion as defined in program guidelines.

Disciplinary Termination

We may immediately terminate enrollment for violations of academic integrity, code of conduct breaches, illegal activities, threats to campus safety, or other serious policy violations. No refund is provided for disciplinary dismissals.

Non-Payment Termination

Failure to meet financial obligations may result in enrollment suspension or termination. Access to classes, platforms, and services will be blocked. Reinstatement requires full payment of outstanding balances plus any applicable reinstatement fees.

Effect of Termination

Upon termination, your access to learning platforms, campus facilities, student email, library resources, and all Institute systems will be immediately revoked. You must return all Institute property including access cards and borrowed materials.

Leave of Absence

Students in good standing may request a leave of absence for approved reasons (medical, personal, professional). Leaves must be formally approved and do not extend program deadlines. Tuition obligations and return conditions will be specified in leave approval.

Survival of Terms

Provisions regarding intellectual property, confidentiality, dispute resolution, limitation of liability, payment obligations, and any other terms that by their nature should survive termination will remain in effect after your enrollment ends.

Dispute Resolution & Governing Law

Disputes arising from these Terms or your relationship with the Institute will be resolved as follows:

Informal Resolution: Before initiating formal proceedings, you agree to first contact our Student Affairs office to attempt informal resolution of any dispute or concern. Many issues can be resolved through direct communication.

Internal Grievance Process: Academic disputes, grading appeals, and disciplinary matters are subject to our internal grievance and appeals processes as outlined in the Student Handbook. You must exhaust internal processes before seeking external remedies.

Mediation: If informal resolution fails, disputes may be submitted to non-binding mediation through a mutually agreed mediator. Mediation costs will be shared equally unless otherwise agreed.

Governing Law: These Terms are governed by the laws of the jurisdiction where the Institute is located, without regard to conflict of law principles. You consent to the exclusive jurisdiction of courts in that jurisdiction for any legal proceedings.

Class Action Waiver: You agree to resolve disputes on an individual basis only. You waive any right to participate in class actions, collective proceedings, or representative actions against the Institute.

Limitation Period: Any legal action arising from these Terms must be commenced within one year of the event giving rise to the claim. This limitation period applies to the maximum extent permitted by applicable law.

Amendments to Terms: The Institute reserves the right to modify these Terms at any time. Material changes will be communicated to enrolled students via email at least 14 days before taking effect. Continued enrollment after notice constitutes acceptance of modified Terms. Current students may complete their programs under Terms in effect at enrollment for non-material changes. For substantial changes, students will be given options including withdrawal without academic penalty.
Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms otherwise remain in full force and effect. The invalidity of one provision does not affect the enforceability of other provisions.
Entire Agreement: These Terms, together with our Privacy Policy and any program-specific agreements, constitute the entire agreement between you and the Institute regarding your enrollment and use of services. These Terms supersede all prior oral or written agreements and understandings.
These Terms of Use were last updated: May 2026. The Shri Mahakal Institute reserves the right to modify these Terms at any time. By continuing to use our services after changes are posted, you accept the modified Terms. We recommend reviewing these Terms periodically. Archived versions are available upon request.
